HOW TO VIOLATE COPYRIGHTED PROJECT AND GET AWAY WITH IT.
Copyright is the exclusive and assignable legal rights, given to the originator for a fixed number of years, to print, publish perform, film or record literacy, artistic or musical material, most company always make their product copyright because it is the fight against, plagiarism and piracy however many people would also like to make use of your product with good intentions.
The Nigerian copyright law (cap 28 law of the federation of Nigeria) permits the holder of a copyrighted work to reproduce the work in any material form, publish the work, it cost N10,000 to get a copyrights patent in Nigeria and $60 USD from outside Nigeria.
The most famous method of identifying copyright materials is by reading through their privacy menu, which will include comments like “this material is the property of the company and should not be use or reproduced”. Also most website shows their products are copyright in the footer of the website, this include your inability to use, recreate or publish any of their contents like images, videos, music or logo.
Although open source projects have been an enormous advantage to the digital world and most especially programming, and yet most people would still be interested in copyright material.
This article is about how to make use of copyright material without permission or alarming problems as developer. To start with; violating a copyright patent is a civil offence and could be dealt with at the federal level under no circumstances should one be toying or joking with such thing. If copyright infringement is a civil offence then you might be considering the possibility of going to jail if the infringement is amount to at a very large scale.
To give, share, send or publish a material with copyright patent is accrued to a violation of copyright and is subject to prosecution under legal jurisdiction in Nigeria.
In Nigeria violating a copyright patent will cost several payment;
· Statutory damages: when a product or material is copyright within 3 months the accused will be liable to pay for statutory damage which the copyright holder will asked.
· Actual damages: when the copyright infringement caused a catastrophic damage to the producer or copyright holder with the proof of the cross profit made by the accused the copyright holder can ask for actual damage by getting compensation off the profit the accused made from using.
· Attorney’s fees and cost: if the publication of the copyright patent occurred within the 3 months the holder can asked for attorney’s fees and court fees for the violation caused by the accused.
· Criminal punishment: depending on the amount of infringement and the damages caused the accused can be charged for felony and sent to prison to spend 10 years maximum with respect to how much he profit
Truly copyright infringement isn’t a habit to adopt or natured without further ado let get to the part where all this laws and order can’t hold
HOW TO USE COPYRIGHT MATERIAL
Earlier on I spoke about open source which is a very good community that help and promote learning in a way that you won’t get charged for infringement but just as much as the word open source sound it is just a project that give free access to everyone in the world and do inversely opposite of copyright. Lol so getting familiar with the term and getting involve is so much important.
FAIR USE
Copyright disclaimer under section 107 of the copyright act 1976 in the United States, allowance is made for “fair use” for purpose such as criticism, comment, news reporting, teaching, scholarship and research. A person can make a copy Apple logo with a meme on it that’s cool, or open a YouTube channel and teach how to make Google logo which is within fair use policy and more importantly to us as a developer is to open our project file and create a website of Microsoft for research and learning which is also within the fair use policy. Without getting frightened by the law and order on copyright the fair use is permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use this status make provision for the balance in favor of fair use.
